Terms of Service

Graduated News — SW Products LLC

Effective Date: May 10, 2026
Last Updated: May 10, 2026

1. Eligibility and Accounts

You must be at least 18 years old to create an account. Parent accounts are for legal guardians who create and manage child profiles. Teacher accounts are for K-12 educators using the Service for classroom purposes. Child profiles may only be created by a parent or legal guardian. You are responsible for maintaining the security of your account credentials. If you believe your account has been compromised, notify us immediately at support@graduated.news.

2. Subscriptions and Payments

Family plans are available at $6 per month or $60 per year. Teacher accounts are free. Payments are billed automatically through Stripe on a recurring basis. Free trials automatically convert to paid subscriptions unless canceled before the trial period ends. You may cancel at any time through the Stripe billing portal; cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused subscription time. Active subscribers receive unlimited article access. Free and lapsed accounts are subject to daily read limits. Reading is never fully blocked — a subset of daily content remains accessible regardless of subscription status.

3. Acceptable Use

You agree not to violate any applicable laws, impersonate another person or entity, attempt unauthorized access to our systems, scrape or reproduce content for commercial purposes outside of the Service, or use the Service in any manner not expressly permitted by these Terms. Teachers agree to use student data solely for educational purposes within the Service and may not share or sell student data outside the Service. Violation of these Terms may result in immediate account termination.

4. Content

Articles published on Graduated News are AI-generated summaries of current events produced for educational purposes and are not a substitute for original source journalism. Source publications are credited and linked where available. Quizzes are AI-generated and may occasionally contain errors — we encourage teachers and parents to use them as learning tools rather than definitive assessments. Teachers are responsible for the content of any sticky notes or annotations they add within the Service. All platform content, design, code, and branding are owned by SW Products LLC and protected by applicable intellectual property law.

5. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you agree to the collection and use of information as described in our Privacy Policy.

6. Teacher Referral Program

Class codes allow students to connect their profiles to a teacher's classroom. Teacher-to-teacher referrals may earn discount benefits as described in the referral program terms. The referral program terms are subject to change. Referral credits have no cash value and are non-transferable.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We make no warranty regarding the accuracy or completeness of AI-generated article summaries or quiz content.

8. Limitation of Liability

To the fullest extent permitted by law, SW Products LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the total amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless SW Products LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or if we discontinue the Service. You may delete your account by contacting us at support@graduated.news. Upon termination, Sections 4, 7, 8, 9, and 11 of these Terms survive and remain in full force.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.

12. Changes to These Terms

We will notify you by email of any material changes to these Terms before they take effect. Continued use of the Service after notice constitutes acceptance of the updated Terms.
