Germany Debates Surrogacy and Hypocrisy

A top German politician who opposed surrogacy at home used a surrogate mother in the US to become a father, sparking a major political debate.

Jens Spahn, a well-known German politician and former health minister, has announced that he and his husband became fathers with the help of a surrogate mother in the United States. A surrogate mother is a woman who carries and gives birth to a baby for another person or couple. The news surprised many people in Germany because Spahn belongs to a party that strongly opposes surrogacy and wants it to stay illegal. His announcement has sparked a heated debate about fairness, politics, and personal choices.

Spahn shared the news with the German tabloid BILD, saying: "My husband has become a dad, and so have I. Georg is our whole world." He described the feeling as hard to put into words. Many Germans were happy for him on a personal level, but others quickly pointed out that his actions seemed to clash with his political beliefs. The story quickly spread across Germany and became a major topic of discussion.

Spahn is a member of the Christian Democratic Union, or CDU, which is a center-right political party in Germany. The CDU has long been against making surrogacy legal in the country. In February 2026, the party passed a statement saying surrogacy should remain banned because of concerns about exploitation, health risks, and ethics. Spahn was at that very meeting when the statement was approved — and at that time, a surrogate mother in the US was already pregnant with his husband's child.

Spahn has spoken out against surrogacy many times over the years. In 2015, he said he personally found the idea of a 'rented womb' very difficult to accept. In 2020, when another party tried to debate changing Germany's surrogacy laws, Spahn opposed the idea, arguing it could create difficulties for a child's sense of identity. Now, many people are accusing him of saying one thing and doing another.

Spahn and his husband do not face any legal trouble for their choice. Surrogacy is legal in the United States, and German law does not punish parents who raise a child born abroad through surrogacy. Only doctors and agents involved in surrogacy within Germany could face legal consequences. So while Spahn broke no laws, critics say he broke the spirit of the rules his own party supports.

Some members of his own party are calling for him to step down from his leadership role. Daniel Peters, head of the CDU in one German state, said Spahn is "no longer acceptable" as a parliamentary group leader and must resign. Peters argued that Spahn has a special duty as a role model and that he "deliberately flouted the law that's in force in Germany" by using a surrogate abroad. The calls for his resignation have put pressure on the entire CDU.

Critics from outside his party also spoke up. Kathrin Gebel of the Left Party said that political standards should apply to private life as well. Janosch Dahmen of the Green Party accused Spahn of double standards, saying politicians who support rules should explain why those rules apparently do not apply to them personally. Germany's chancellor, Friedrich Merz, stayed quiet and simply said he had congratulated Spahn on becoming a parent.

It is still unclear whether this controversy will seriously hurt Spahn's political career. The 46-year-old has faced major scandals before, including buying overpriced protective masks during the COVID-19 pandemic that led to legal disputes worth billions of euros. Even so, he has remained one of Germany's most influential politicians. Whether this new debate will change that remains to be seen.
