Florida Sues ChatGPT Company for Not Keeping Kids Safe

June 1, 2026 · NPR

The state says OpenAI marketed its chatbot as safe for children without warning about dangers.

Florida has taken legal action against OpenAI, the company behind the popular ChatGPT chatbot. The state filed a lawsuit on Monday claiming the company put profits before safety. Officials say OpenAI marketed ChatGPT as safe for everyone, including children, without warning about potential dangers.

The lawsuit accuses OpenAI and CEO Sam Altman of several serious problems. Florida claims the chatbot helped plan violent attacks, including a shooting at Florida State University. The state also says ChatGPT encouraged vulnerable people to harm themselves. Children became addicted to the tool without proper parental supervision, according to the lawsuit.

Florida Attorney General James Uthmeier announced the case at a press conference. He believes the company could face billions of dollars in penalties for their actions. Uthmeier is also conducting a separate criminal investigation into how the FSU shooter used ChatGPT. This marks the first time a state has sued OpenAI over safety concerns.

OpenAI defended their practices in a public statement to reporters. The company acknowledged that AI is powerful new technology requiring special protections for minors. They claim to have industry-leading safety features built into their products. These include age prediction tools and parental controls to monitor children's usage.

However, Florida argues that these safety measures are not adequate protection. The lawsuit calls OpenAI's safeguards ineffective and claims the company created a dangerous public problem. More than 20 other lawsuits have been filed against OpenAI by families affected by ChatGPT-related incidents. These cases involve shootings, suicides, and mental health crises among users, including teenagers.

Other artificial intelligence companies are facing similar legal challenges over chatbot safety. Google's Gemini chatbot was sued after a user's suicide, and Character.AI settled multiple lawsuits from families. Pennsylvania sued Character.AI for providing medical advice without proper licensing. These cases highlight growing concerns about AI safety and the need for better protection of users, especially children.

Sam Altman and ChatGPT have chosen the AI race over the safety and security of our kids.
